WE, AT SLEEP AI LTD. ("WE"), TAKE YOUR PRIVACY SERIOUSLY. WE RESPECT AND PROTECT THE PRIVACY OF OUR USERS AND TAKE APPROPRIATE STEPS TO SAFEGUARD THEIR PERSONAL INFORMATION. THIS PRIVACY POLICY (THE "POLICY") EXPLAINS THE TYPES OF INFORMATION THAT WE RECEIVE AND COLLECT WHEN YOU USE OUR SYSTEM AND THE RELATED SERVICES OFFERED BY US AS PART OF THE SYSTEM (THE "SERVICES"), AND DESCRIBE THE WAYS WE USE AND PROTECT THEM.
ALL TERMS NOT DEFINED HEREIN IN SPECIFIC, SHALL HAVE THE MEANING ASCRIBED TO THEM IN THE TERMS OF USE
THE USE OF THE SYSTEM AND/OR ANY OF THE SERVICES, IS SUBJECT TO THE PROVISIONS OF THIS POLICY.
THIS POLICY MAY BE UPDATED FROM TIME TO TIME, THEREFORE WE ASK YOU TO CHECK BACK PERIODICALLY FOR THE MOST UPDATED POLICY, AS INDICATED BELOW. YOUR USE IN THE SYSTEM AND/OR YOUR USE OF ANY OF OUR SERVICES, AFTER THIS POLICY HAS BEEN AMENDED, SHALL BE DEEMED TO BE YOUR CONTINUED ACCEPTANCE OF THE TERMS OF THIS POLICY, AS AMENDED.
Information we collect
Our primary goal in collecting personal information is to provide You, the user of the System, with a customized and efficient experience, and therefore We only collect personal information that is relevant for such purpose.
Personal Information means information that identifies or could be used to identify an individual, directly or indirectly.
We collect the following types of information from our users:
Registration Data. As a condition for the use of the System, and engaging with us, If you are a patient, You will be required to provide certain information concerning You by way of filling in a short anonymous health questioner (the "Registration Data"). Please be advised that you will not be required to provide any information that may identify you to us such as name, email or other identifiable detail however your doctor will have access to all of the Collected Data (as defined herein) included in your account and you will be identified in front of your doctor.
If you are a doctor, You will be required to provide the following Registration Data: Name, License ID, email
You may review and edit your Registration Data by using your login details.
You may, at all times, replace your doctor with any new doctor listed in our systems that you choose by notifying us at shirelattia@sleep-ai.org or your doctor and we shall replace your doctor in the new one.
2. Automatic Tracking. By the nature of its functionality, the System will be able to, and may track certain information about You, in order to perform internal research on our users' demographics, interests, site usage patterns and behavior. This information is collected in an aggregate form, without usually identifying any user individually, except with respect to user IP Address that is considered as personal information. Non-personally identifiable information may be analyzed by us for the purpose of improving and expanding the functionality of our Services as well as to improve the System.
3. Collected and Processed Information. As part of using the System, we may ask you to provide certain additional Information concerning you such as your age, sex, height, weight, skin color, smoking status, sport habits, sleep habits, medical background and beta blockers administration, (the "Uploaded Materials")
Processed Information. As part of your use in the System, subject to your consent, the System may collect certain information and parameters concerning You that are collected from the oxymeter provided to you by the Company, such as physiological data from oximetry-based device including oxygen saturation, heart rate, motion, plethysmography and shall provide analysis, summaries, recommendations and inputs concerning them ("Processed Data")
Registration Data, Automatic Tracking, Uploaded Materials and Processed Data shall be referred to herein as "Collected Data"
The System shall provide the Collected Data to your doctor. We do not oblige you to do so, and it is not a condition for using the System but only subject to your sole discretion and therefore You may choose not to provide all or part of the Collected Data and/or to define the System not to collect certain Collected Data, or not to make certain process to the materials however by doing so, we may not be able to provide you with the full scope of the services.
The use of the System will be made solely by You. Please do not upload any Collected Data that is not yours.
We will not sell, trade or rent your Collected Data to others, except as specified in this Policy.
Collected Data, will be owned by You and licensed to the Company for use by the Company in accordance with the terms of this Privacy Policy and you further approve to disclose them to your Doctor as part of using the System.
Information that we collect shall be saved and stored at the following secured databases and platforms: Google cloud, Mongo, Google Firebase under the Company's registered database, that will be controlled by the Company.
Cookies
Cookies are very small text files that are stored on your computer when You visit certain websites and can store information about your use of the System. We use a combination of few types of cookies such as session cookies and persistent cookies, in order to track, how You use and experience the System, build anonymous statistical data about how the System is performing, to make the Services more customized and to inform us of a repeat visit without knowing who a visitor is or its personal information. Please ensure that other third parties that provided such information are aware of such fact.
Usage of Information
Internal Use. We use the Collected Data for internal purposes, to improve the System, and to better tailor them to meet your needs. In addition, We use the Collected Data to analyze usage, and to deliver You information about certain promotions, services or items that might interest You. We may use Your e-mail address to contact You from time to time, in order to notify You about new services and updates. If You do not wish to receive such mailings, simply notify us in email to: shirelattia@sleep-ai.org
Improving the System. We will use the Collected Data to improve the use and troubleshoot problems, bugs and errors in the System including developing new models, approval of the current models improving the System and extending our line of products and services.
Advertising. We may advertise and promote the System or any of the Services and its contents, however, We will not disclose, sell or transfer any Collected Data (other than automatic tracking) to any third parties for the purpose of advertising or promotion (e.g., advertisers or business partners), except as specified in this Policy.
Third Parties. We may at any time add affiliate partners such as clinics and hospitals or 3rd party content providers to our System, but the sharing of Collected Data with them will be limited to only unidentified information.
You hereby consent to permit us, to process and transfer the Collected Data, as necessary for us to provide You with our Services.
Special Cases. We may disclose Collected Data, in special cases when we were ordered to do so by a judicial authority, to respond to subpoenas, court orders and law enforcement or government request or when we have reason to believe that disclosing such Collected Data is necessary to identify, contact or bring legal action against someone who may be violating this Policy or may be causing injury to or interference with (either intentionally or unintentionally), our rights or property, other users, or anyone else that could be harmed by such activities.
We may disclose Collected Data as part of a process of due diligence for investment of M&A transaction as well as to our service providers such as accountants and/or legal advisors as well as third party storage entities.
We shall disclose all types of Collected Data concerning You to the doctor that will be connected to you in our System for the purpose of providing You with the Services of the System.
Protection of Information
Information is encrypted and protected by firewall and by Secure Sockets Layer (SSL), the industry standard, for encrypting all Collected Data.
Although, We use industry standard practices to protect your privacy, We do not guarantee, and You should not expect that Collected Data will always remain completely private.
While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform specific work are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.
Disclosure Information in the Event of a Merger
We may merge or be acquired by another business entity or may sell all or substantially all of our assets to an acquirer. In the event of such merger, acquisition or sale, We may share some or all or your Collected Data with the acquiring company in order to continue serving You the Services. In such event and if applicable, We will provide notice that such information is transferred and may become subject to a different privacy policy.
Access to your personal information
You have the right to view, amend, or delete the Collected Information that we have collected and hold about You, and the way it is processed via your personal area in the System.
In case You wish to receive additional information about your Collected Data that is stored with Us, please contact Company's DPO listed below this policy and We will provide the information free of charge in a commonly use and machine readable format within 14 days, except in the event that the request is unfounded, excessive or repetitive, in which case we reserve the right to charge a proportionate administration fee or refuse.
You shall have the right to request us to amend any Collected Data concerning You and we shall apply to your request promptly after receipt of your request by Company's DPO.
Your right of Deletion, limitation or to be forgotten
You may request the deletion of any and all Collected Data, at any time and to request that we cease further dissemination of the data, and have third parties cease processing of the data by submitting a request to Company's DPO.
You shall have the right, at any time, to request to limit the Collected Data that You wish to be saved or processed, and Company shall comply with your request.
Be aware that requesting total deletion of all your Collected Data, unlike unsubscribing, is total and irreversible. This means that we will also lose record of You having ever been on our systems. If You choose in the future to open a new account, You will appear to us as completely new customer.
To request deletion, limitation or amendment of your Collected Data, contact Company's DPO indicating your full name identified in your Account and your detailed request and we shall promptly respond to it.
We may save part of the Information that: (i) we are permitted to save by law (ii) is saved as automatic backup at our servers (iii) we are required to save for internal use.
Governing Law; Jurisdiction
This Privacy Policy shall be construed and governed under and by the laws of the State of Israel. The parties agree that exclusive venue for any legal action relating hereto shall be in the courts of Tel Aviv - Jaffa. The parties agree not to contest the venue set forth herein and to submit to, and not contest, the exercise of personal jurisdiction over them by any of the foregoing courts.
